This privacy policy (the “Privacy Policy”) relates to the information collection and use practices of ArtVersion (“ArtVersion,” “we,” “our,” or “us”) in connection with our online services, which are made available to you through our platforms, (the “Platform”), our website located at ArtVersion.com (the “Site”), and our mobile application (the “App”).

DESCRIPTION OF USERS AND ACCEPTANCE OF TERMS This Privacy Policy applies to visitors to the Site and the App, who view only publicly-available content (the “Visitors”) and users who have signed up to access and use the website and all services offered by ArtVersion through the Platform (the “Users”). BY ACCESSING AND USING THE SITE AND THE APP, VISITORS ARE ACKNOWLEDGING THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS PRIVACY POLICY AND OUR TERMS OF USE (THE “TERMS OF USE”), WHICH ARE HEREBY INCORPORATED INTO THIS PRIVACY POLICY AND MADE A PART HEREOF BY REFERENCE (COLLECTIVELY, THE “AGREEMENT”). IF YOU DO NOT AGREE TO ANY OF THE TERMS IN THE AGREEMENT, YOU MAY NOT ACCESS OR USE THE SITE OR THE APP. BY SIGNING UP, ACCESSING, AND/OR USING THE PLATFORM, EACH USER IS AGREEING TO THE TERMS OF THIS PRIVACY POLICY AND THE APPLICABLE USER AGREEMENT (THE “USER AGREEMENT”). Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use (when such term concerns Visitors), or the User Agreement (when such term concerns Users).

WEBSITE SERVERS

ArtVersion servers are located in the United States, however we use Cloudflare as a CDN provider. A content delivery network (CDN), or content distribution network, is a geographically distributed network of proxy servers and their data centers. The goal is to provide high availability and performance by distributing the service spatially relative to the end-user. WHAT PERSONAL DATA WE COLLECT AND WHY WE COLLECT IT

In the course of operating the Site, and/or interacting with you, ArtVersion will collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information and assume contractual responsibility for obtaining all consents as required under applicable laws and regulations.

WEBSITE COMMENTS

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

MEDIA

If you are transmitting any images to us or the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

CONTACT INFORMATION

When you contact us through the “Contact Us” page, or sign up to become a User, you will be asked to provide certain information, which may include first name, last name, e-mail address, job title, name of your organization, country, state/region and phone numbers (fax, cell and/or landline) (“Contact Information”). The Contact Information is used to provide the requested service or information and to contact Users and Visitors for purposes of direct marketing of our current and future services.

COOKIES

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

EMBEDDED CONTENT FROM OTHER WEBSITES

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

BILLING INFORMATION

In order to purchase products or services from us, you may be required to provide certain additional information, which may include a credit card number, expiration date, billing zip code, activation code, and similar information (“Billing Information”). Billing Information is collected and processed by our third-party payment processor operating as our agent (see, Onward Transfers to Third Parties).

USER DATA

In using the Platform, Users grant us permission to access User Data from Data Sources, such as Users’ social media channels, payment processors, and financial institutions. We use the User Data in accordance with the terms and conditions of the User Agreement. Generally, though not always, we obtain the User Data from the Data Sources via API feeds. Users may add or remove approved Data Sources at any time pursuant to the User Agreement. Any User Data collected from Data Sources will be used in accordance with this Privacy Policy and the privacy policy of the Data Source. OTHER INFORMATION

In addition to the Contact Information, the Billing Information, and the User Data, we may collect or receive the following information:

  • From Your Activity. In an ongoing effort to improve the Site, the App, and the Platform, we automatically collect certain information when Visitors visit the Site and the App, and when Users use the Platform. This information consists of IP addresses, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Site and/or App Visitors visit, and similar information concerning your use of the Site, the App, and the Platform (“Activity Information”).
  • From Cookies. We also collect Activity Information by using “cookie” technology. Cookies are small packets of data that a website stores on the hard drive of your computer or mobile device to “remember” information about your visit. We may use session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer/device until you delete them).   • Analytics and Remarketing. We use one or more third–party analytics services (such as Google Analytics) to evaluate your use of the Site, the App, and the Platform, compile reports on activity (based on their collection of IP addresses, Internet service provider, browser type, operating system and language, referring and exit pages and URLs, data and time, amount of time spent on particular pages, what sections of the Site and/or the App you visit, number of links clicked while on the Site or the App, search terms and other similar usage data), and analyze performance metrics. These third parties use cookies and other technologies to help analyze and provide us the data. By accessing and using the Site, the App, and/or the Platform, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy.   • Aggregate Data. In an ongoing effort to better understand our Visitors, our Users, their users, the Site, the App, and the Platform, we may analyze your information in aggregate form to operate, maintain, manage, and improve our services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our services and the Site to current and prospective business partners and to other third parties for other lawful purposes.   • How We Use the Information. Further to the uses described above, we use Information primarily to provide our services. For example, we digest, analyze, and organize the Information using our proprietary analytics methods, and prepare content derived from such information and analytics. Such content is then distributed to our Users, in various formats including, but not limited to, email digests and PDF reports, for use by Customers in their businesses. In addition, we may use the Information to create audience segments for Users, and to publish automatic social media posts on behalf of our Users as part of our services pursuant to the User Agreement. We may also reproduce, execute, use, store, archive, modify, enhance, aggregate, combine with other data, perform, display, distribute, sell, rent, vend, or otherwise exploit Anonymous Data for any purpose, including, without limitation, to create audience segments, to enhance our other data and sell such enhanced data, or to improve our Site, App, Platform, and our services. Further, we use Information to respond to general inquiries, solicit feedback regarding our services, provide relevant content, provide support, and to communicate with you via email regarding our current and future services.

ONWARD TRANSFER TO THIRD PARTIES

Like many businesses, we hire other companies to perform certain business-related services. We may disclose Information, including personal information in some cases, to certain types of third-party companies, but only to the extent needed to enable them to provide such services, including, without limitation, hosting services, database management/back-up services, and payment processing. All such third parties function as our agents, performing services at our instruction and on our behalf pursuant to contracts which require they provide at least the same level of privacy protection as is required by this Privacy Policy and implemented by ArtVersion.

With regard to the principle of Accountability for Onward Transfer, for example, we remain liable if our agent processes such personal information in a manner inconsistent with the Privacy Shield Principles, unless we prove that we are not responsible for the event giving rise to the damage.

OPT-IN TO CERTAIN ONWARD TRANSFERS

If you are a European resident, we will not transfer your personal information to a third party acting as a controller without first providing you with information regarding the identity of such controller or the nature of such controller’s business, and obtaining your opt-in consent.

BUSINESS TRANSFER

DISCLOSURES TO PUBLIC AUTHORITIES

You should keep in mind, however, that no Internet transmission is 100% secure or error-free. In particular, e-mail sent to or from the Site, the App, and/or the Platform may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail or other electronic means. Where ArtVersion has given you a username and/or password that enables you to access certain parts of the Site, the App, or the Platform, you are responsible for keeping such username and/or password confidential.

The Site, the App, and the Platform may, from time to time, contain links to external websites. ArtVersion encourages you to review the privacy and security policies of any externally linked websites that may be accessed through the Site, the App, or the Platform. ArtVersion assumes no responsibility or liability for the information collection and disclosure practices of any external websites that a user can access through the Site, the App, or the Platform. ACCESS TO PERSONAL INFORMATION

Upon request to https://artversion.com/contact-us, we will provide you with confirmation as to whether we are processing your personal information, and have the data communicated to you within a reasonable time. You have the right to correct, amend, or delete your personal information where it is inaccurate or has been processed in violation of this Privacy Policy. We may require payment of a non-excessive fee to defray our expenses in this regard. Please allow us a reasonable time to respond to your inquiries and requests.

YOUR CHOICES

Should you choose to unsubscribe from any mailing lists for which you registered, you may do so by following the instructions on how to unsubscribe provided in all ArtVersion communications.

WHAT RIGHTS YOU HAVE OVER YOUR DATA

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

HOW LONG WE RETAIN YOUR DATA

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

We will retain your personal information in a form that identifies you only for as long as it serves the purposes for which it was initially collected as stated in this Privacy Policy or subsequently authorized. We may continue processing your personal information for longer periods, but only for the time and to the extent such processing reasonably serves the purposes of archiving in the public interest, journalism, literature and art, scientific or historical research, and statistical analysis and subject to the protection of this Privacy Policy. ArtVersion does not knowingly collect or receive personal information from children under the age of 13 through the Site, the App, and/or the Platform. If you are under the age of 13, please do not provide any personal information through the Site, the App, and/or the Platform. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children to never provide any personal information on the Site, the App, or any other web site without their permission.
